HISTORIC LEGISLATIVE REVIEW FOR THE CREE BOARD OF HEALTH AND SOCIAL SERVICES OF JAMES BAY

The CBHSSJB Board of Directors and Executive Direction are pleased to report that following years of tireless efforts and advocacy, the Ministry of Health and Social Services has committed to embark on a thorough legislative review process to modernize the current act.

On April 26, 2024, we received a letter from Minister Dubé acknowledging the high-level discussions to date, and emphasizing the commitment of MSSS to pursue collaborative efforts with a view to modernize Chapter S-5. 

Since 1971, we have been operating under the Act respecting health services and social services for Cree Native persons (Chapter S-5). This was a result of the James Bay and Northern Québec Agreement Section 14 which set out a fundamental Cree-Québec partnership. 

The CBHSSJB has proposed a legislative review to: 

  • update the outdated Québec law (Chapter S-5) which has applied to the CBHSSJB since the 70s; 
  • recognize greater responsibility and flexibility for the CBHSSJB to achieve its vision and mission; 
  • reflect Cree identity, treaty status and special circumstances, including Cree language, culture and values; 
  • enable the CBHSSJB to adopt Eeyou Miyupimaatisiiun and Nishiiyuu Healing Methods, adapted Cree Youth Protection regime to meet Cree needs, special contracting regime, and adapted working conditions & training, with Cree hiring priority. 

Following multiple meetings and exchanges, and the submission of much documentation to support the creation of a New Eeyou Eenou Health and Social Services Act, our Chairperson, Bertie Wapachee met with Minister Christian Dubé, and proposed that he commit to the legislative review process. 

Going forward, the negotiating representatives of the CBHSSJB, Cree Nation Government, MSSS and other Québec ministries will continue to meet regularly, joint sub-tables by subject matter will be established as needed, and internal CBHSSJB working sessions will review specific articles with relevant stakeholders. 

This is a huge milestone for the CBHSSJB to evolve our organization and services, for which we recognize and appreciate the efforts from all parties in taking these important steps to better health and social services in Eeyou Istchee.
